Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BusinessHRM website and application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
1. The service
BusinessHRM provides an all-in-one platform for HR, time tracking, projects, CRM, finance and support. We may add, change, or remove features over time. We will give reasonable notice of material changes that adversely affect your use.
2. Accounts
You are responsible for your account, for keeping credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorised use. You must provide accurate information and keep it current.
3. Acceptable use
You agree to use the Service in compliance with our Acceptable Use Policy and all applicable laws. Where you enable employee monitoring features, you are responsible for obtaining any consents and providing any notices required in your jurisdiction.
4. Your data
You retain ownership of the data you submit to the Service (“Customer Data”). You grant us a limited licence to host, process and transmit Customer Data as needed to provide the Service. Our handling of personal data is described in our Privacy Policy and, where applicable, our Data Processing Agreement.
5. Fees and billing
Paid plans are billed per seat on a monthly or annual basis. Fees are charged in advance and are non-refundable except as stated in our Refund Policy. You authorise us to charge your payment method for applicable fees. We may change pricing with reasonable notice that takes effect on your next billing cycle.
6. Trials
We may offer a free trial. At the end of the trial, your plan will begin unless you cancel. We may modify or discontinue trials at any time.
7. Intellectual property
The Service, including its software, design, and content, is owned by us and our licensors and protected by law. These Terms do not grant you any rights to our trademarks or branding.
8. Third-party services
The Service may integrate with third-party services. Your use of those services is governed by their own terms, and we are not responsible for them.
9. Termination
You may cancel at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends, and we will handle your data as described in our Privacy Policy.
10. Warranties and disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
12. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Disputes will be resolved in the courts located in San Francisco, California, unless applicable law requires otherwise.
14. Changes
We may update these Terms from time to time. We will post the updated version here and revise the date above. Continued use after changes take effect constitutes acceptance.
